We are an auction site for Buyers and Sellers. We do not endorse any of the goods that are sold through the Site, nor is SonnyBoyAuctions involved in the actual transactions between Buyers and Sellers. SonnyBoyAuctions does not guarantee that any Seller will complete the sale of an item or any Buyer will complete the purchase of any item. We reserve the right to update, supplement, revise, modify and/or amend these terms at any time without prior notice to you. All updates, supplements, revisions, modifications and/or amendments shall automatically be effective as soon as they are posted on this Site and your continued use of the Site constitutes your acceptance of said updates, supplements, revisions, modifications and/or amendments. SonnyBoyAuctions is a site for the entire family and vulgar or inappropriate language will not be tolerated. We reserve the right to edit, delete or modify content at our discretion. General You use SonnyBoyAuctions.com at your own risk. Buyers and Sellers agree to verify that it is legal to buy, receive, sell and/or send any item listed or bid upon on SonnyBoyAuctions in their particular state or locality. SonnyBoyAuctions is not responsible for any unlawful transactions and/or transfers. SonnyBoyAuctions users agree to hold SonnyBoyAuctions harmless if any loss or damage is experienced through use of this site or service, or in connection with this service. SonnyBoyAuctions is not responsible for any damage or loss caused by errors in the site or system or by interruption of Internet traffic. SonnyBoyAuctions.com is not responsible for any inappropriate use of this site or system, or for SonnyBoyAuctions users sending unsolicited commercial or non-commercial email to other users. SonnyBoyAuctions users agree NOT to: · Abuse our mail system · Distribute or post spam and/or send any unsolicited commercial or non-commercial email to other users · Distribute viruses or spyware and/or any other technologies that may harm SonnyBoyAuctions or the interests or property of our users · Harvest or otherwise collect information about our users, including email addresses · Manipulate the price of bids · Interfere in any way with other users’ listings Eligibilty SonnyBoyAuctions is available only to individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors under 18 years of age, or if you are temporarily or permanently disabled from our Site. SonnyBoyAuctions is only available to residents of the Fifty (50) United States. We are unable to accommodate Non-U.S./International users at this time. If you reside outside of the Fifty (50) United States, you may not use our services. All fee and bid prices shall be quoted in U.S. Dollars. Registration/User Information When you register with our Site, you will receive a user ID and a Password. SonnyBoyAuctions.com strongly recommends that you safeguard the confidentiality of your User ID and Password. You are entirely responsible for any and all activities, which occur under your User ID and Password. By registering as a member of and using SonnyBoyAuctions.com, you agree to any and/or all of the following: · to provide true and accurate information about yourself in the registration file · to maintain a valid email address and phone number in your user information file · to remove/adjust all email SPAM filters which may interfere with properly receiving email from SonnyBoyAuctions.com host address or from the other party in a Buyer/Seller transaction · to immediately notify SonnyBoyAuctions.com of any unauthorized use of Member’s User ID or any other breach of security known to member at customerservice@SonnyBoyAuctions.com · all transactions and/or transfers do not violate any applicable local, state, federal and/or international laws or regulations SonnyBoyAuctions reserves the right to discontinue your service at any time and for any reason. SonnyBoyAuctions will remove or edit any auction it deems, in its sole discretion, to be illegal, inappropriate, offensive, misleading, fraudulent, in poor taste, or in violation of these terms and conditions. Without limiting the foregoing, failure to maintain a valid email address and/or phone number on file may result in your account being disabled. Moreover, SonnyBoyAuctions may terminate your membership and any or your current auctions or bids immediately if SonnyBoyAuctions is unable to verify or authenticate any information you provide to us. Your email address and phone number will be provided to the other party involved in any Buyer/Seller transaction. Membership We will be offering a membership program to all of our visitors and although not mandatory to use the site, we will offer benefits that non-members will not have access to, such as discounted fees. Buying In order to bid on items on SonnyBoyAuctions you must be registered with a valid password and credit card on file. You may bid on any items listed for sale but keep in mind that your bid is a binding contract and if your bid is the highest at the end of the auction, you are legally bound to complete the transaction. Our Buying screen (coming soon) will take you through the process step by step and teach you how to be a successful bidder on SonnyBoyAuctions. Selling The same requirements apply to sellers. You may sell your items on SonnyBoyAuctions at your leisure. All listed items must be advertised realistically and we require that you describe them honestly and include any imperfections which would negatively effect their desirability. Items misrepresented or not “as listed” can be returned by the buyer to the seller for a full refund. Our Selling screen will guide you through the listing process as well as provide you the opportunity to download pictures to further enhance your listing and increase the chances for a successful auction. As in buying, your ad is a legally binding contract that states that your item is “as listed” and that you will ship it to the buyer in described shape and as quickly as possible. Feedback Every buyer or seller completing a transaction on SonnyBoyAuctions will have the opportunity to describe their experience and comment on their overall satisfaction with the process. This information must be honest, forthright and not degrading or vulgar. We reserve the right to delete anything we deem inappropriate. We feel that it is very important that our members, buyers and sellers police themselves and provide honest information about how they felt their transaction was handled in order to maintain the integrity of our community. Termination of Account by Member Should you become dissatisfied with our Service in any way, or object to our Terms and Conditions or subsequent amendments, your sole recourse is to (1) discontinue your use of SonnyBoyAuctions.com; and (2) terminate your membership via written notification to: Termination of Account : SonnyBoyAuctions P.O. Indemnification You will indemnify and hold SonnyBoyAuctions, its subsidiaries, affiliates, agents, officers and employees harmless from any claim or demand including reasonable attorneys’ fees made by any third party due to or arising out of your use of this site, the violation of any of these Terms & Conditions, or the violation of any law or the rights of a third party. Law and Forum for Disputes These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia.
